These provisions contain important details and explanations regarding how Open Minds, its parents, subsidiaries, affiliates, licensees and assigns (collectively “Open Minds”) collects, shares, and uses information from its website (www.bayareaopenminds.org) and Users’ choices about privacy when using the website. The Terms of Use incorporate the terms of this Privacy Policy therein, and the terms of the Cookie Policy. If you do not agree to the Terms of Use, this Privacy Policy, or the Cookie Policy, then you must leave our website and not use our Content.

 Open Minds may collect and use Personal Information about its Users. "Personal Information" is information that can be used to identify a User, such as their first and last name, email address, zip code/postal code, billing address, shipping address, phone number, age, date of birth, social security number, and occupation. Open Minds may collect the following additional information:

  1. Details of Users' visits and the resources accessed, including, but not limited to, traffic data, location data, weblogs and other communication data, including Internet Protocol address, browser type, the date and time the website was accessed or left, and which pages were viewed.
  2. Information that Users directly provide to Open Minds by filling in forms, applications or other paperwork on the website, including the User’s name, email address, street address, telephone number, email address, professional licensing information, occupation information, or other information.
  3. Information provided to Open Minds when Users communicate with Open Minds for any reason, including information provided in emails User send to Open Minds, or submissions that Users may make.
  4. Open Minds may engage third parties to provide analytics about the use of the website, data processing and management, account management, hosting, customer and technical support. Third-party cookies are covered by the third-party’s privacy policy.

B. How Personal Information is Used

 Open Minds uses the Personal Information it collects to help operate, improve, protect and customize our website and Content, as well as develop new services. In addition to the other uses of information described in this Privacy Policy, Users' Personal Information may be used for the following purposes:

  1. To provide Users, including via a User’s email address, with information relating to Open Minds' website and Content and those of its partners, and affiliates;

D. Third-Party Websites and Advertisers

 This Privacy Policy does not address, and Open Minds is not responsible for the privacy, information or other data collection, storage and use practices of any third party to which the website links, any wireless carriers, or any other third parties who provide services in connection with your access and use of the website. Open minds recommends you review the privacy policies of each third-party site, wireless carrier, or service provider prior to using the website. The inclusion of a link on the website does not imply Open Minds' endorsement of, or affiliation with the site.

E. Opt-Out

To opt out of receiving materials from Open Minds, contact Open Minds using the contact information set forth below.

Users may opt out of receiving emails by unsubscribing from Open Minds’ email list at any time by clicking on the unsubscribe link the emails we send or by contacting Open Minds using the details provided below. Users will then be removed from the email list – however, Open Minds may still communicate with users, for example to send service-related emails that are necessary to respond to service requests.

F. "Do Not Track" Requests

 Do Not Track is a privacy preference that users can set in certain web browsers. No uniform technology standard for recognizing and implementing Do Not Track signals has been finalized. Open Minds does not currently recognize or respond to browser-initiated Do Not Track signals.

G. California

 California law allows California residents to ask companies with whom they have an established business relationship to provide certain information about the companies’ sharing of Personal Information with third parties for direct marketing purposes. Open Minds does not share any California consumer Personal Information with third parties for marketing purposes without consent. California users who wish to request further information about Open Minds’ compliance with this law or have questions or concerns about Open Minds’ privacy practices may contact Open Minds using the contact information set forth below. This information is obtainable free of charge once a year.

1. CCPA Privacy Notice

 The California Code of Regulations defines a "Resident" as:

    • Every individual who is in the State of California for other than a temporary or transitory purpose and
    • Every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose.

 Anyone outside this definition is a "Non-Resident."

We collect the following categories of personal information:

    • Identifiers: contact details (such as, real name, alias, postal address, telephone number, or mobile contact number, unique personal identifier, online identifier, IP address, email address and account name)
    • Personal Information Categories Listed in the California Customer Records Statute: Name, contact information, education, employment, employment history and financial information
    • Protected Classification Characteristics Under California or Federal Law: Gender and date of birth
    • Commercial Information: Transaction information, purchase history, financial details and payment information.

Open Minds may also collect other Personal Information outside of these categories instances where you interact with us in-person, online, or by phone or mail in the context of:

    • Receiving help through our customer support channels;
    • Participation in customer surveys or contests; and
    • Facilitation in the delivery of our website and Content and to respond to your inquires.

Regarding your Personal Information, you have the right to know:

    • The categories of Personal Information we collect;

    • Objecting to the processing of your Personal Information;
    • Requesting correction to your Personal Information if it is incorrect or no longer relevant;
    • Designating an authorized agent to make a request under the CCPA on your behalf.
    • Requesting to opt-out from future selling of your Personal Information to third parties.

Open Minds will not discriminate against you if you exercise your privacy rights.

H. European Union

 Open Minds' website is hosted and operated in the United States and elsewhere in the world. By using the website, Users consent to the transfer of their Personal Information to the United States. If Users are accessing the website from outside the United States, please be advised that United States law may not offer the same privacy protections as the law of your jurisdiction.
